General trading terms of the Meditation & More GmbH

1. General

The General trading terms apply to all contracts, deliveries and other services.
Deviating regulations of the contracting party we do not accept except the Meditation & More GmbH agreed with these in individual cases in writing. Special conditions apply to the e-commerce which are separately characterized as such under the respective points.

2. Offers

Our offers are noncomittal. Deviations and technical changes to our illustrations or descriptions are possible.The respective prices shown in our Online-Shops lose their validity with appearance of a new edition of the shops.
Only adult persons (starting from 18 years) can order by Internet.

3. Conclusion and resignation of a contract

The Meditation & More GmbH is committed to accept the order of the customer to on the Website indicated conditions. With writing, computing or data base errors on the Website, with negative result of a credit rating and if the commodity for a substantial period is not available, the Meditation & More GmbH reserves for itself the possibility of cancelling the contract. The customers receive a confirmation of their order. With orders by Internet a sales contract is only locked if the Meditation & More GmbH confirms the order by E-Mail.

4. Delivery and payment

With order through the Internet following procedure takes place: Delivery within Germany happens after payment in advance, through Sofortüberweisung, by credit card, PayPal or at the time of payment by direct debit authorization, abroad after payment in advance or through Sofortbanking-Direct Payment (from Austria, Belgium, Italy, Netherlands), by credit card or PayPal. The forwarding expenses portion is shown in the shopping basket or the Internet purchase order form. All prices contain the legal value added tax in their valid height (at present 7% with books and magazines, all other articles 19%), in the case of delivery to Non- European Union countries the value tax is not added. The same applies in the case of delivery to European Union countries outside of Germany with indication of a valid EU-VAT-NR.

5. Delivery times

All incoming orders are processed and made ready for dispatch within 1 working day.
For available articles the delivery time is within Europe generally 2-4 working days depending on the adress of the customer, for Osho discourses on audio and video cassettes 7-10 working days. For goods, which are not in stock, the delivery time can amount to up to 3 weeks.

6. Guarantee

We ensure that the sold goods are free of any material and factory defects and are of the assured characteristics at the time of delivery. The customer has to examine all goods with for condition and any apparent defect at the tome of delivery. In the case of apparent defect during the period of guarantee this must be announced within 14 days in writing to us. The delivered articles have to be held ready for inspection by the Meditation & More GmbH in the condition in which they are at the time of the statement of the apparent defect. An offence against these obligations excludes any warranty claim towards the Meditation & More GmbH. The guarantee expires, if the supplied goods are changed or not used as intended. We have the right for rectification. A partial or complete exchange of the article is permissible. If the guarantee case is not cleared within an appropriate period, the buyer has the right for exchange or reduction. The Meditation & More GmbH is not responsible for damage, which did not develop at the delivered articles.

7. Retention

All goods remain our property up to the complete payment.

8. Privacy Statement - Data Security

The customer agrees with the collection, storage, processing and use of personal data in the context of the order procedure for contractual purposes and on basis of the data protection regulations. The data are used exclusively for internal purposes. We reserve ourselves the right to make these data available to an appropriate data base in case of disregard of the terms of payment to protect our entitled interests. The possibility for the input of personal or business data (email addresses, name, addresses) exists in reference to the data security and to the coding in our Internet Shop. Passing on these data takes place on the part of the user with his free will. An order of our products is not possible without these data. The data are not conveyed to a third party. Our shop system needs like most Internet shop systems so-called "Cookies". Cookies are small text files, which will be stored on your hard disc. These files contain among other things information about which products are in your basket, whether you visit our side the first time etc. If you do not permit a setting of Cookies in your Browser, our shop system does not function. Then an order is not possible. Our entire shop is coded by the company GlobeCharge (www.globecharge.com) using 128-Bit-SSL. Therefore an espionage of your data through third party is almost impossible .

Withdrawal

You have the right to cancel within fourteen days without giving any reason this contract. The withdrawal period is fourteen days from the date on which you have or a representative of your third party who is not the carrier has taken possession of the goods.

In order to observe the revocation period it is sufficient for you to send the message about the right of withdrawal before the withdrawal deadline.

Effects of withdrawal

If you withdraw from this contract, all the payments that we have received from you will be returned, including delivery costs (with the exception of the additional costs arising from the fact that you have chosen a type of delivery other than standard offered by us), and must be repaid immediately at the latest within fourteen days from the date on which the notice is received through your cancellation of this contract with us. For this repayment, we use the same method of payment that you used for the initial transaction, unless you explicitly agreed otherwise; in no case you will be charged fees for this repayment.
We may withhold the reimbursement until we have received the goods back or until you have demonstrated that you have returned the goods, whichever is the earlier.

You have to return the goods promptly and in any event not later than fourteen days from the date on which you notify us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days.

You bear the direct cost of returning the goods.

You only need to pay for any diminished value of the goods, if the deterioration in value is due to a not necessary usage of the goods exceeding to ascertain the nature, characteristics and functioning of the goods received.

Exclusion of the right of withdrawal

The right of withdrawal does not apply to contracts

-for the supply of goods which are not prefabricated and if for their production an individual choice or decision by the consumer is important or which are clearly tailored to the personal needs of the consumer

-for the supply of sealed goods which are unsuitable for reasons of health or hygiene to return when their unsealed after delivery (all Aura soma products)

-for the supply of audio or video recordings in a sealed package.
